In my daily practice, I encounter people who try to play data protection and digitisation off against each other. This eristic dialectic2 is something you can only avoid and quickly put an end to. It is a false dilemma3 mostly used in the absence of expert knowledge and arguments.
In the meantime the German Federal Constitutional Court in Karlsruhe made a landmark ruling regarding Article 82 GDPR4. Responsible persons and managing directors should be concerned about their liability. Many of them are not aware of the “appropriate compensation” within GDPR wowards subjects. The FAZ5 expects a wave of lawsuits like those ones during the diesel scandal.
